The Association was started in August 2015 after a major power failure at 4100 Ponytrail Drive.
Our power was out for 30 hours, there was one notice from management that they were looking into the situation. From that Saturday afternoon at 2:15 August 1 to Monday August 3 in the early afternoon, we had no lights, hot water, refridgeration, means of cooking, or air conditioning during a heat wave. Tenants were literally left in the dark, management's lack of communication was terrible. The elevators were running intermittantly and breaking down with people being trapped until someone rescued them.
A few concerned tenants decided to take action and form a group to address this and may other issues in both buildings.
The association took action opposing the development of two additional condiminium buildings.
Local area residents and tenants were concerned about the condition of the existing buildings and the lack of proper maintenance.
Our concillor Chris Fonseca initiated an attached to the development agreement call Schedule F which listed 12 items that the landlord acknowledged and agreed to undertake .
Late in 2017 we received notice from the landlord that they had applied for an AGI (above guideline increase) of 3% for 3 years t cover expenses for some of the items on Schedule F. The tenants were surprised, believing that those costs were to be paid by the developer as part of the agreement with the City.
In early 2018 we attended the Landlord Tenant Board hearing to fight the increase. Unfortunately the LTB chose the landlord's position that these were improvements and not repairs. We did manage to get the terms reduced slightly when we pointed out that the city allowed $93,000 of development funds for the elevator improvements. The landlord failed to note those funds in the expense summary!
The association on several occasions acted to resolve tenant issues with management and remained in contact with Councillor Fonseca regarding the continuing elevator problems.
During this time the underground parking garages were updated. Each underground took the better part of 2 years and tenants were forced to park outside for the duration of construction.
The remnants of the tennis and basketball courts were removed once the undergrounds were completed. The pool had to also be removed.
2024 - The landlord slapped tenants with another AGI for 3% for 3 years. effective June 1 2024.
Again tenants were upset with another large increase to pay for improvements outlined in Schedule F.
2026 - A virtual meeting for tenants of 4100 was held with a mediator and a representative of the builder to negotiate a settlement. As some tenants did not pay the addtional 3% for a period of 2 years the tenants who attended were concerned about the arrears that would become immediately payable. This was confirmed during the meeting.
We settled with the provision that tenants would have 120 days to pay. We have since found out that the LTB will allow up to 12 month to pay when large sums of money are involved.
1850 has not resolved the AGI at the time of writing.
